Brazil’s new [rules](https://www.in.gov.br/en/web/dou/-/medida-provisoria-n-1.068-de-6-de-setembro-de-2021-343277275) appear to be the first in the world to make certain types of content takedowns illegal under national law, even as other national governments around the world implement rules that force social media companies to take down more types of content proactively. ## **What do the rules say?** The decree targets what Bolsonaro’s presidential press office called “arbitrary removal” of content including accounts, profiles and posts. Under the new rules, tech companies must only remove posts if they fall under a narrow set of definitions including terrorism, threats of violence, sexual crimes and cyberattacks, unless they obtain a court order. The measures would prevent social media companies from easily removing content including medical and political misinformation. Bolsonaro has repeatedly posted misinformation about [COVID-19](https://time.com/5895452/trump-coronavirus-bolsonaro-johnson/), and has claimed that voter fraud would be the only explanation if he loses the upcoming October 2022 presidential election—something [pollsters say is likely](https://www.reuters.com/world/americas/brazils-lula-could-beat-bolsonaro-first-round-2022-vote-poll-shows-2021-06-25/). Many lawmakers have already spoken out against the rules. But even if the measures expire, they could act as a blueprint for conservatives around the world who have rallied against what they see as censorship by social media platforms. Kanchan Gupta, a senior adviser to the Indian government, which is [waging its own war on social media platforms](https://time.com/5946092/india-internet-rules-impact/), shared the news from Brazil approvingly on [Twitter](https://twitter.com/KanchanGupta/status/1435079758711189507) on Tuesday. “Social media platforms cannot deplatform inconvenient voices,” he said. “In effect, this is cancelling cancel culture. YouTube said in a statement that it was “closely analyzing” how the new Brazilian rules impact the way the company regulates content in the country. “We’ll continue to make clear the importance of our policies, and the risks for our users and creators if we can’t enforce them,” YouTube said.
