The Bracamonte family is finally getting rid of their nightmare nanny. The family of five, fired live- in nanny, Diane Stretton, three weeks ago, but in a nightmarish twist, the 64- year- old refused to leave the family's California home. This saga began in March, when the family hired Stretton. They say at first she was great with their three kids, but then complained of health problems, and spent all day locked in her room. Now the nanny from hell has finally agreed to pack her things and go. But what could the Bracamontes have done to avoid this whole situation? Matriarch Marcella told People the family found Stretton after posting an ad on Craigslist, and they did a background check, but maybe that's not all they should have done.

My family is the most important thing, so of course I did a background check, I called references, I didn't do a credit check, because I wasn't accepting money from her. I just didn't think it was necessary, I was too trusting. The police haven't been able to remove Stretton, because the family would have to formally evict her, which can take months to complete. Stretton has agreed to move out, but says she wants to gather her things on July 4th. Which has the Bracamontes hesitant, because they'll be out of town, and worried that she might forcibly lock them out. So, what can they do in the mean time?

Well, nothing. According to Marcella, they could pay a fine of up to $ 1000 for disrupting their tenant. The San Diego Union Tribune reports, Straten is considered a vexatious litigant in California, which means she has been found to bring legal action that is frivolous or repetitive.
