## Transcript

Officer Harrity said he then heard a sound he described like a light bulb dropping unto the floor and saw a flash. Harrity checked to make sure that he was not shot, then looked to his right and saw Officer Noor's right hand extend across him towards Officer Harrity's open window. Officer Harry then looked out his window and saw a woman. Miss Damon Rushack \ g had put her hands on the wound on her left side of her abdomen and said, I'm dying or I'm dead. Justine was approaching the car unarmed. They couldn't even tell whether it was a male or a female, or adult or a child. And the officer [ UNKNOWN ] who was closer to her, the [ UNKNOWN ] couldn't see their hands.

What is the threat that require to use a deadly force? What was the serious crime that was going on? All of which are requirements And I think what we're saying in this charge is that Officer Newer did not act reasonably, did not act objectively reasonably, and abused his authority to use deadly force. He reaches across in front of his partner, shoots a gun at an object that he can't see. That's evidence of a depraved mind in my view.
