## Transcript

The family of an Ohio inmate plans to sue the state after his execution had some unexpected consequences. Dennis McGuire was put to death via lethal injection, Thursday. He was convicted in 1994 for the kidnap, rape, and murder of 22- year- old Joy Stewart who is pregnant at that time. McGuire's execution was the first of the nation to use a new combination of lethal drugs, midazolam and hydromorphone. The new drugs were given to McGuire after European- based manufacturer stops selling the previous drug used for lethal injections. The controversy over the never- before- tested drug cocktail reignited as McGuire took his last breaths.

Media report say it took anywhere from 10 to 25 minutes for McGuire to die.

>> There was a kind of a snoring through his nose. At couple of times, he definitely appeared to be choking. I never see anything that lasted so long.

>> McGuire's attorneys tried to stop the execution last week saying their client would go through unnecessary suffering, but the State disagreed. One lawyer told the New York Times that media reports might be blown out of proportion. Inmate does get a sedative as the very first thing. However distasteful it might be to observe, he is not in any kind of extreme pain that ought to concern us. McGuire's children who were present at his execution said Friday they'd be seeking an injunction on further executions. Ohio plans to carry out five more executions this year. There's no word on whether those will be put on hold.
