Can you please get behind? >> There's no construction going on now. >> The fence is expected to span some 700 miles of the 200 miles southern border from California to Texas. Much of it across federally owned property. But in South Texas, the fence will rise in populated areas where Department of Homeland Security officials say illegal border crossers can easily make their way north. The federal government has condemned hundreds of acres of land including land that belongs to Eloisa Tamez. >> I mean we're being charged with committing our meager landholdings to solve a problem-- an issue that is-- that is long term. It's been going on for generations. The governments have not been able to solve it. -[ Foreign Language ] >> This Sunday morning, friends visit Tamez's property to pay homage to Saint Santiago and bless her tiny 3 acres. This tiny portion is part of a 12, 000 acres deeded to Eloisa Tamez's ancestors by the King of Spain more than 300 years ago. Each generation divided it into smaller portions. 3 acres is all that Eloisa has of that once vast ranch land. And now, that's being cleaved in two by the federal government's wall. >> You know, we-- that's-- this is our spirit, our spirit. When you combine the earth and the water to give life, that's our spirit. And, you know, we are being-- our spirit is being broken. -[ Foreign Language ] I guess to kinda claim what's ours one more time. >> Tamez has joined nearly 100 other families in lawsuit to force the federal government to negotiate with them before condemning their land. >> We, Americans, are expected to be American and to be truly following the constitution. However, that's not what the government does to us. >> When congress approved the border fence, it gave Homeland Security Secretary Michael Chertoff sweeping powers to waive federal laws and he has. Some 36 in all including laws protecting water, air, and endangered species. The waivers and land condemnation proponent say are necessary to expedite the construction of the fence in the interest of national security. >> More has to be done at the border, more has to be done with SBInet, virtual fence, real fence, all of which address a very, very real concern of the American people that we have to show we can secure our borders. >> I mean, the fact that it's estimated that hundreds of thousands of people cross over the border undetected illegally every year would indicate that we don't have effective control right now. >> But the massive project has hit cost overruns and delays. Recently, congress committed an additional $ 400 million to the multi- billion- dollar project. >> I ask myself why. Why are they wanting us, the meager landholders, to sacrifice what little we have to have a Band- Aid solution? Locals here say when most Americans think of the southern border, they think of it as a river, checkpoints, and immigration agents. And with that image in mind, Tamez says it's easy to forget that the people who live here are Americans too and their land is part of the United States. >> I believe that the country should be secure. I'm proud-- I'm proud to be from America-- an American with so much heritage. I mean, to me, I have a right-- I have a right to this land. It's mine. It's not-- It's part of who I am with all my ancestry. >> We come from a long line of love and we follow the teaching and example of those who have gone before us. >> If the massive border project continues on course, it likely will be up to the next president to determine if this wall will continue to rise. >> You, oh Lord, know our hearts. >> And these people pray it will not.
