## Transcript

An argument over texting in the North Tampa movie theater ended with a 43- year- old man dead and his wife wounded. 71- year- old retired police captain, Curtis Reeves was charged with second degree murder after official say he [ unk ] shot Chad Oulsen who was texting his 3- year- old daughter during the preview of a movie Monday. Witnesses told police someone threw a popcorn. They say Reeves asked Oulsen several times to stop texting and then left the theater. When he returned they said the argument escalated. Reeves pulled out a gun say witnesses and shot Oulsen in the chest. Oulsen stumbled and fell onto a teen, that teen's father talked to reporters.

>> I can't' believe people would bring a pistol or gun to a movie. I can't believe they would argue and fight and shoot one another over popcorn.

>> After the gunshot, police say an off- duty deputy subdued Reeves and a nurse attempted to revive Oulsen until officers and paramedics arrived. Along with a no- texting policy the theater also had a no- weapons policy, but Reeves apparently violated that. In Florida guns are banned in some places even for a concealed permit holders, but that doesn't apply to movie theaters. In a press conference Pasco County Sheriff, Chris Nocco says investigators looked into whether the shooting could have been justified under the state's stand your ground law, but determined it wasn't. The alleged shooter was a former Tampa police captain who retired 20 years ago and helped create the department's tactical response team.
