The framers of the Constitution, they knew, that they were embarked on an experiment in government. They knew that, they were seeking to a create a more perfect union, not a perfect union, but a more perfect union. They were worried, that if they made a list of what rights we had, then sooner or later, something would happen, and somebody would say, but you didn't put that on the list, it isn't a right. So the 9th amendment is this, important reminder that even though we've explicitly enumerated, listed a whole bunch of rights, don't read that list as exclusive. There are other rights that we have mentioned, and by the way, some of those rights are rights we haven't discovered yet. [ MUSIC ] Not too many of the framers were thinking about gay marriage but gay marriage is obviously a very big issue today. At the founding, no criminal defendant, could take the stand in his own defense, and under oath say, I didn't do it. Today, every criminal defendant can take the stand. The, the most important and the most controversial, is the right of privacy. And, of course, it is the right of privacy on which, on many of the controversial decisions relating to abortion rights have been founded. [ MUSIC ] The 9th amendment. recognizes, that the 1st 8 amendments, have not articulated all of the conceivable rights and liberties, that American's enjoy. That they hadn't gotten all of the rights, written down in those 8th 8 amendments, but they'd done their very best.
