Excessive bail shall not be required. Nor excessive fines and holds. No cruel and unusual punishments inflicted. The Eighth Amendment is borrowed from the English Bill of Rights of 1689. One American twist on it is that it reflects in America a particular anxiety about judges. Excessive bail. Excessive bail shall not be required. Nor excessive fines imposed. And setting bails, in sentencing the judge is acting on his own, and so the Eighth Amendment says we need some special rules about that, some special protections, cuz we're nervous about federal judges acting on their own. Nor cruel and unusual. Nor cruel and unusual. Nor cruel and unusual punishments inflicted. The prohibition against cruel and unusual punishment. That's a definition that has evolved over time. [ LAUGH ] Of course the standard rule of thumb for punishment was an eye for an eye and a tooth for a tooth, but it was also a common and delightful diversion to witness public floggings. Or hangings. And by the standards of much of the 18th century that would not have been cruel and unusual punishment. Today society is being tested. What do we mean by cruel and unusual punishment when it comes to something such as [ MUSIC ] The death penalty, lethal injection, an whether or not, the poison that's being placed in a persons system, is a poison that kills quickly, painlessly, or does it allow for a certain amount of lingering, pain. Also we have, recent US Supreme Court decisions, in which it's been decided that cruel an unusual punishment, can be the overcrowding of prisons. [ MUSIC ] The Supreme Court has held that you can't execute someone who committed a murder while they were a minor. And then very recently the Supreme Court said that minors can't be subjected to life without parole. I think it's fair to say that we've had a, a, a liberal and I must say more humane A definition of what constitutes cruel and unusual punishment.
