First seeing it, it's difficult to explain. Our investigation has determined that Officer Van **** was on the scene for less than 30 seconds. Before he started shooting. However, after watching it several times, and most importantly, getting the perspective of my client, that is when I came to the conclusion that his his actions were justified. He began shooting approximately six seconds after getting out of his vehicle. When he jumped out of the car, The subject made a motion which put my client in fear that this individual was perhaps going to attack him with a knife. The officer then open fire on LaQuan who's arm jerks, his body spins around and he falls to the ground. While LaQuan is falling to the ground, the defendant takes at least one more step towards him. At which point the angle of the dash camera changes and we can no longer see the officer within the frame of the video, two seconds later, La'Quan McDonald is laying in the street on his right side. The reason my client Jason fired his weapon that evening back in October 2014 is that He truly was in fear for his life as well as the lives of his fellow police officers.
