As protesters gathered in [ unk ] to rally against same sex marriages, a Federal Judge ruled Thursday evening, the State's ban was unconstitutional. >> It's the first Southern State to strike down a voter approved Gay Marriage ban. The Virginia judge did issue a state order while it's appealed that means gay couples will still not be able to marry until the case is resolved. Judge Arenda Wright Allen who's been in the Federal bench for nearly three years now, specifically noted in her ruling, the law she overturned was voter approved. In part, the 41 page ruling reads, " Our constitution declares that all men are created equal, surely this means all of us. While ever vigilant for the wisdom that can come from the voices of our voting public, out courts have never long tolerated the perpetuation of loss rooted in unlawful prejudice. A [ unk ] couple first filed as plaintive and were later joined by another couple from Richmond. Predicatively, many protesters sided their religion beliefs for opposing same sex marriages. But much of their anger was also directed toward New State Attorney General Mark Herring. After his election in November, the Democrat announced he didn't believe the ban was constitutional and wouldn't defend it. It would seem Virginia is just the latest domino to fall in what many view as an inevitable march back to the US Supreme Court. The Virginia ruling came down just one day after another Federal Judge ruled Kentucky same sex marriage ban, invalid. Time called Judge John Heyburn's decision remarkable considering his conservative roots. Heyburn wrote, " Kentucky's laws treat gay and lesbian persons differently in a way that demeans them ." While the Supreme Court overturned part of the defense of marriage act last summer saying the Federal Government must recognize same sex marriages in states where it's legal.
