The Department of Homeland Security [alleged](https://x.com/DHSgov/status/2076798878595342620) in a statement Monday evening that ICE was surveilling a residence around 7 a.m. local time when an “illegal alien” left the address in a car. ICE agents tried to stop the vehicle, the statement continued, alleging that the driver then attempted to flee. “Fearing for public safety, an officer discharged his weapon,” the statement continued. DHS claims that emergency services were contacted immediately; however, the driver died from his injuries. By mid-afternoon, the shooting victim was identified by local advocacy groups as a 26-year-old Colombian man who “came to Maine to live and work,” according to a[ joint statement](https://maineimmigrantrights.org/maines-immigrant-community-responds-to-ice-shooting-in-biddeford/) by the Maine Immigrants’ Rights Coalition and Presente! Maine. The statement said that the man was authorized to work in the United States and had been issued a Social Security number. TIME has not independently verified this information. Later in the evening, multiple sources had identified the man as [Joan Sebastian Guerrero](https://www.wmtw.com/article/joan-sebastian-guerrero-killed-by-ice-biddeford-maine/71928327), who was married and had a 3-year-old daughter. Speaking to CNN late Monday, Maine Sen. Angus King [said](https://edition.cnn.com/2026/07/13/us/video/ac360-king-ice) that DHS was not pursuing Guerrero at the time, referring to a conversation he had with Homeland Security Markwayne Mullin. Biddeford’s local paper, the [_Biddeford Gazette_](https://www.facebook.com/permalink.php?story%5Ffbid=pfbid035tyrViGEr8hBA4zcQ3mU24zpLnuiGPqYkHJxXimc22ijYH991UkumAW5LD7oFdwql&id=61568756346470), reported that an eyewitness saw flashing lights on an unmarked Ford Explorer at an intersection just before 7:20 a.m. The witness told the _Gazette_ that he saw at least two officers surround a white sedan, yelling very loudly, before he heard at least four gunshots. Another witness spoke to the [_Portland Press Herald_](https://www.pressherald.com/2026/07/13/biddeford-witness-saw-gunshot-victim-bleeding-from-head-2/), saying he had heard gunshots and rushed to the window in time to see officers pulling a man from his vehicle. “He was bleeding profusely from the head,” Daniel Boucher told the news outlet. “He was talking. He said, ‘I tried to stop.'” Boucher said that he believed he watched the man die on the street. “I know that situations like these are alarming and frightening,” Maine Gov. Janet Mills, a Democrat,[ wrote](https://www.maine.gov/governor/mills/news/statement-governor-mills-fatal-shooting-biddeford-2026-07-13) in a statement released just before noon. “The Maine State Police are at the scene supporting and working cooperatively with the Attorney General’s Office, Maine’s Office of Chief Medical Examiner, and Federal officials to determine the facts of what occurred this morning.” Project Relief Maine, a racial justice and immigration advocacy group operating in the state, said on[ social media](https://www.instagram.com/projectreliefme/p/DavC958JGU7/?hl=en) that one of their “community members was killed during an encounter with ICE.” “We are in contact with the family and are committed to supporting them during this unimaginable time,” Project Relief said in the statement at midday. “This was a young person whose life was cut short, and our community must come together to stand with their loved ones and ensure they are not alone. They must get justice.” Maine Rep. Chellie Pingree said in a [video](https://www.facebook.com/reel/3068640003476574) posted to social media that she was “deeply disturbed” by the reports. “Were they pursuing someone with a criminal record? Was this a random traffic stop? How did this possibly happen and why was this person shot? Were the officers wearing body cameras?” she wrote. “But more than anything else, I want to know 'why are you in Maine?'” Pingree, a Democrat, has been outspoken as ICE has heavily increased its presence and activity in Maine in recent weeks. MIRC [reported about a 35% uptick](https://www.pressherald.com/2026/06/25/data-shows-reports-of-ice-activity-in-maine-have-risen/) in hotline calls about ICE sightings and detentions in May and June, as compared to April. ## ICE’s second fatal shooting in a week The incident comes less than a week after an [ICE officer fatally shot a man](https://time.com/article/2026/07/08/what-we-know-about-the-fatal-ice-shooting-in-houston/), 52-year-old Lorenzo Salgado Araujo, while conducting a traffic stop in Houston, Texas. DHS said that Araujo rammed into an ICE vehicle while attempting to evade an arrest and that the officer fired his weapon in self-defense. There were three men in the car with Araujo at the time who contradict that scenario, [according to their lawyer](https://www.youtube.com/watch?v=S5xUL3XXhwY). Araujo’s family and community members have demanded an investigation into his death. ICE’s use of force against civilians continues to come under heavy scrutiny following the killings of two people during ICE’s [immigration crackdown](https://time.com/7368923/minneapolis-ice-operation-protests-renee-good-alex-pretti/) earlier this year in Minneapolis. Alex Pretti and Renee Good’s deaths sparked outrage across the country and led to mass protests in Minneapolis. Good was also inside her vehicle when she was shot. The Trump Administration on Tuesday ordered ICE officers to halt "most" vehicle stops while carrying out operations across the country, sources familiar with the matter told TIME. Mullin, who replaced Kristi Noem at the helm of DHS in March, had pledged to run operations more [discreetly](https://www.politico.com/news/2026/07/06/mullins-mark-on-dhs-ending-the-drama-noem-unleashed-00985012) than his predecessor had. But ICE has not managed to stay out of the headlines, and _The New York Times_ [reported](https://www.nytimes.com/2026/07/01/us/politics/ice-immigrant-arrests-surge.html) a surge in arrests, with federal immigration officials arresting 10,000 people in a five-day period earlier this month. TIME has reached out to DHS for comment. Maine Secretary of State Shenna Bellows, who ran in the Democratic primary for governor and is currently pursuing Graham Platner's [former seat](https://time.com/article/2026/07/13/lindsey-graham-senate-seat-vacancy-congress-gop-replacement/) in the Senate, also commented on the shooting on Monday. "It's time to get ICE off our streets," she wrote [on X](https://x.com/shennabellows/status/2076672016149590159). Daniel Kanstroom, a professor at Boston College Law School, tells TIME that while it is too early to comment on the recent shootings, there are “profound problems” with ICE operations that have yet to be addressed. “The agency has expanded very quickly. I think the training practices were very questionable. I think some of the formulations of the mandate by \[White House Deputy Chief of Staff\] Stephen Miller and others were extremely broad and put a lot of pressure on agents to produce very high numbers in very short periods of time,” he says. Miller set a [target](https://www.theguardian.com/us-news/2025/may/29/trump-ice-arrest-quota) of 3,000 arrests per day for ICE in early 2025\.
