Acting Attorney General Todd Blanche revealed Castro’s federal indictment on Wednesday at the Freedom Tower in downtown Miami, during an event honoring the four U.S. nationals killed in the 1996 shoot-down. Castro as well as five airmen in the Cuban air defense forces face charges of conspiracy to kill U.S. nationals. Castro also faces murder and destruction of aircraft charges. “For the first time in nearly 70 years, senior leadership of the Cuban regime has been charged in this country, in the United States of America, for acts of violence resulting in the deaths of American citizens,” Blanche said. “Nations and their leaders cannot be permitted to target Americans, kill them, and not face accountability.” The plan to indict Castro,[ first reported by CBS News last week](https://www.cbsnews.com/news/us-moving-to-indict-cubas-raul-castro-officials-say/), comes as U.S. President Donald Trump toys with the idea of military action in Cuba. Trump has mentioned Cuba often in the context of[ Venezuela](https://time.com/7344628/us-venezuela-trump-maduro-oil-drugs-war-explainer-questions-answered/) and[ Iran](https://time.com/7382631/iran-israel-us-war-explainer-trump-middle-east/)—two other countries where the U.S. military has taken action this year. The indictment of Raúl Castro, the 94-year-old brother of the late Cuban revolutionary leader Fidel Castro, comes just months after the U.S. forcibly extradited[ Venezuelan President Nicolás Maduro](https://time.com/7342941/venezuela-maduro-bombing-trump-delta-force/), who faces charges of narco-terrorism and conspiracy to import cocaine, among others. The Castro indictment also appears part of a larger Trump Administration attempt to force Cuba to kowtow to U.S. demands. Trump[ imposed tariffs on countries](https://time.com/7373215/cuba-us-blockade-oil-venezuela/) that supply oil to Cuba, aggravating its longstanding energy crisis and, in effect, causing widespread blackouts as well as food shortages. His Administration has[ also imposed a fresh wave of sanctions](https://www.state.gov/releases/office-of-the-spokesperson/2026/05/sanctions-to-counter-threats-posed-by-the-cuban-regime-fact-sheet/) against Cuban regime actors and entities, and he floated a “friendly takeover” of the country, which he said he would have the “honor” to oversee. But after the indictment, Trump [denied](https://www.youtube.com/watch?v=CwQB96husNE) there would be an escalation in the Caribbean island country. “I don’t think there needs to be,” Trump told reporters Wednesday. “Look, the place is falling apart.” Havana has repeatedly pushed back against Washington’s broader pressure campaign. Its President Miguel Díaz-Canel criticized the U.S. government, [calling](https://x.com/DiazCanelB/status/2057157886208606381) the indictment of predecessor Castro “a political maneuver, devoid of any legal foundation, aimed solely at padding the fabricated dossier they use to justify the folly of a military aggression against Cuba.” ## **Who is Raúl Castro?** Raúl Castro, alongside his older brother Fidel, helped topple the U.S.-backed regime in Cuba and pushed the country toward a communist revolution. For about five decades from 1959, Castro served as the Minister of the Revolutionary Armed Forces, solidifying his power within the military and the country and garnering supporters called _Raulistas_. As minister, Castro helped thwart the U.S.’s attempted invasion of the island in 1961 through the _Bahía de Cochinos_ (Bay of Pigs) in Cuba’s southern coast. Raúl Castro served as acting President in 2006 when Fidel fell ill, and he formally took over the presidency in 2008\. He held the presidency until 2018, when Díaz-Canel took over, and stepped down as leader of the Communist Party of Cuba in 2021 but remains an influential figure in Cuban politics. ## **What does the indictment allege?** Unsealed on Wednesday, the [superseding indictment](https://www.justice.gov/opa/media/1441506/dl) against Castro and five other members of the Cuban air defense forces was approved by a grand jury and filed on April 23\. The indictment is based on the 1996 downing of two planes operated by the Miami-based humanitarian group Brothers to the Rescue, when Castro was defense minister. The group, founded by Cuban emigrés, mainly patrolled waters between Florida and Cuba in search of refugees. The indictment alleges that in the early 1990s Cuban authorities sent spies to, among other unspecified tasks, infiltrate Brothers to the Rescue. Castro and the Cuban regime, after receiving intel and in response to Brothers to the Rescue’s civilian flights and the dropping of pro-democracy leaflets in Cuban territory from 1994 to 1995, trained their fighting pilots to locate and follow similar aircraft. By January 1996, Castro allegedly authorized the use of “deadly force” against Brothers to the Rescue. On Feb. 24, 1996, three planes carrying Brothers to the Rescue members entered an area near the 24th parallel. Cuban air defense forces blew two of three planes out of the sky, and the third which carried the group’s leader managed to escape. Four men—Carlos Costa, Armando Alejandre Jr., Mario de la Peña, and Pablo Morales—died. Castro and the five airmen were charged with one count of conspiracy to kill U.S. nationals. Castro and co-defendant Lorenzo Perez, an airman on the Cuban fighter jet that shot down the civilian planes, also face two counts of destruction of aircraft and four counts of murder. If convicted, Castro and his co-defendants face a maximum penalty of death or life imprisonment on the counts of murder and conspiracy to kill U.S. nationals, and up to five years in prison for each count of destruction of aircraft. ## **What was the aftermath of the attack?** The plane attack was met with swift action and condemnation from then-U.S. President Bill Clinton, who [signed](https://2001-2009.state.gov/p/wha/rls/fs/2001/2596.htm) the Cuban Liberty and Democratic Solidarity (LIBERTAD) Act that codified the economic embargo on the country. Years later, in 2001, the leader of a Cuban spy ring, Gerardo Hernández was [convicted](https://www.nytimes.com/2001/12/13/us/leader-of-cuban-spy-ring-given-life-in-prison.html) in the U.S. of conspiracy to commit murder in connection with the downing of the two aircraft, and he was sentenced to life in prison. In 2014, however, Hernández was returned to Cuba in a [prisoner swap](https://time.com/3721603/cuba-raul-castro-espionage-gerardo-hernandez-cuban-five/) under President Barack Obama. A Cuban air force general and two airmen were also charged with [murder](https://edition.cnn.com/2003/LAW/08/21/cuba.pilots/), but they were never tried. In a [February 2026 letter addressed](https://mariodiazbalart.house.gov/sites/evo-subsites/mariodiazbalart.house.gov/files/evo-media-document/02.13.26-letter-to-potus%5Fcuba-indict-raul-castro.pdf) to the President, several lawmakers including Rep. Mario Díaz-Balart (R, Fla.) urged the Justice Department to consider indicting Raúl Castro over the shootdown. The following month, Florida’s Attorney General [said](https://apnews.com/article/florida-cuba-investigation-brothers-to-rescue-shootdown-e4e217b26a0a20a0e6f4adc9318e9a87) he was reopening a state-level investigation into the 1996 incident. Cuban authorities have justified the attack. Fidel Castro,[ speaking to TIME in 1996](https://time.com/archive/6728688/this-cold-war-is-back/), said that the decision to shoot down the planes came after the organization made repeated attempts to drop leaflets on Havana that were critical of his government and urged Cubans to topple him. “We instructed the armed forces that we would not tolerate it again,” Fidel Castro said. Cuba’s Ministry of Foreign Affairs claims the U.S. “distorts other historical truths about the event it uses as a pretext.” In a [statement released after the indictment](https://misiones.cubaminrex.cu/en/articulo/statement-revolutionary-government-35), the ministry argued that the U.S. omitted complaints Cuba filed with the State Department and other agencies then about repeated violations of their airspace. But the U.N.’s International Civil Aviation Organization found in its report several months after the incident that the two planes were in international airspace when they were shot down and that Cuba acted without using standard interception procedures.
