The court's ruling, known as an administrative stay, came after the Trump Administration [appealed](https://time.com/7331317/snap-benefits-november-payments-trump-withholding-court-order/ "undefined") a federal judge's order to fully fund the program by Friday. The ruling will keep millions of Americans who are reliant on food aid on a knife's edge. The benefits lapsed at the beginning of this month for the first time in the program’s 60-year history, leaving many recipients reliant on food banks. Most SNAP beneficiaries are low-income families, seniors, and people with disabilities. They now face an anxious wait as the legal wrangling over the program continues in the coming weeks. Anti-hunger groups condemned the delay caused by the Supreme Court ruling. "The Trump Administration’s decision to continue to fight against providing SNAP benefits furthers the unprecedented humanitarian crisis driven by the loss of the nation’s most important and effective anti-hunger program," said Crystal FitzSimons, president of the Food Research & Action Center (FRAC), a nonprofit that supports anti-hunger programs. "This delay sends a troubling message: the Trump administration is not interested in addressing the urgent needs of people who are struggling in this country, and instead has chosen to prolong this unnecessary hardship," she added in a statement. ## Longest shutdown in history The SNAP program has become a political bargaining chip in the [ongoing government shutdown](https://time.com/7322340/government-shutdown-immigrants-healthcare/ "undefined"), which has dragged on as Republicans refuse to extend Affordable Care Act subsidies for low- and middle-income Americans, which are set to expire at the end of the year. The administration had initially planned to suspend SNAP payments altogether in November, citing a lack of funds due to the government shutdown. But U.S. District Judge John McConnell in Providence, Rhode Island, ordered the administration on Oct. 31 to partially fund the program using emergency funds from the U.S. Department of Agriculture (USDA). "The evidence shows that people will go hungry, food pantries will be overburdened, and needless suffering will occur," McConnell said during a virtual court hearing. The Department of Justice challenged McConnell's ruling, telling the Supreme Court that it would "sow further shutdown chaos" by prompting "a run on the bank by way of judicial fiat." But a gap between the Friday deadline in McConnell's earlier ruling and the Supreme Court's stay led some states to issue full SNAP payments. Hours before the Supreme Court’s order, the USDA released a memo to states saying it was working to comply with the order. That led to New York, New Jersey and Massachusetts directing state agencies issuing SNAP benefits in full for November. In a response to the Supreme Court's decision, U.S. Attorney General Pam Bondi called McConnell’s ruling "judicial activism at its worst." “A single district court in Rhode Island should not be able to seize center stage in the shutdown, seek to upend political negotiations that could produce swift political solutions for SNAP and other programs, and dictate its own preferences for how scarce federal funds should be spent,” she wrote on X. ## **Behind Justice Jackson's ruling** Jackson, a former President Joe Biden appointee, has emerged during Trump’s second term as a key [dissenter](https://www.cnn.com/2025/07/09/politics/ketanji-brown-jackson-leading-dissenter-trump-era "undefined") on some of Trump’s key policies—particularly regarding emergency appeals. Steve Vladeck, professor of law at the Georgetown University Law Center, wrote in response to the order that Jackson was “stuck between a rock and a hard place.” “\[T\]he way she structured the stay means that she was able to try to control the timing of the Supreme Court’s (forthcoming) review—and to create pressure for it to happen faster than it otherwise might have,” Vladeck [wrote in his newsletter](https://substack.com/home/post/p-178324847 "undefined"). Jackson writes more in her stay than any Justice usually would, wrote Vladeck, which sends a specific message. “Here, Justice Jackson is clearly telling the First Circuit to hustle—a message I am sure the court of appeals will receive and act upon.” Vladeck postulated that the liberal Justice Jackson likely administered the stay because she believed it would be “worse” if one of her colleagues released an administrative stay that would have been an indefinite pause for the Trump Administration. Her ruling, though, allows her to “directly influence the timing” of both the lower court and the Supreme Court, Vladeck added. ## **What is SNAP?** Normally, [SNAP benefits](https://time.com/7272755/what-is-snap-challenges-it-faces-under-trump-administration-rfk-jr/ "undefined") are paid monthly to eligible Americans who, usually, must have a [gross monthly income ](https://www.pewresearch.org/short-reads/2023/07/19/what-the-data-says-about-food-stamps-in-the-u-s/ "undefined")at or below 130% of the [federal poverty guidelines](https://aspe.hhs.gov/topics/poverty-economic-mobility/poverty-guidelines "undefined").
