His pick comes after an almost year-long vacancy on the court, created when [Justice Antonin Scalia](http://time.com/4220770/antonin-scalia-influence/) died on Feb. 13, 2016\. Former President Barack Obama [nominated Merrick Garland](http://time.com/4260899/merrick-garland-supreme-court-nominee-president-obama/) last year, but [Senate Republicans refused](http://time.com/4284158/obamas-low-key-barnstorming-for-a-supreme-court-nominee/?iid=sr-link7) to hold confirmation hearings for him, arguing that the new president should have the responsibility of appointing a new justice. During his campaign, Trump released a [list of potential nominees](http://time.com/4505960/donald-trump-supreme-court-list-names/), and some [abortion rights activists](http://motto.time.com/4653998/donald-trump-abortion-supreme-court/) and [Democratic organizers](http://time.com/4655132/democrat-leaders-president-trump-protest-supreme-court-pick/) have already begun pushing lawmakers to oppose his pick.
