The Montana Supreme Court overturned a one-month prison sentence on Wednesday handed to a former high school teacher convicted of raping a 14-year-old student, the Associated Press reports.
District Judge G. Todd Baugh originally handed down a light sentence because he believed that the victim had some control over the sexual situation, saying she was “older than her chronological age.” The teenage rape victim in question killed herself after the assault, before the teacher was tried.
Justices ruled Wednesday that a new judge needs to re-sentence defendant Stacey Dean Rambold. Prosecutors will seek a minimum of four years in prison.
