Amber Heard and Johnny Depp Are Still Finalizing Their Divorce Settlement

After tangling over the details of their divorce settlement for the past three months, Amber Heard and Johnny Depp are days away from finalizing it, her lawyer says.

“The settlement documents are being finalized and will be signed this week,” Heard’s attorney, Pierce O’Donnell, tells PEOPLE in a statement.

Heard was awarded $7 million in the settlement this past summer, and announced she would donate all of the money to her two favorite charities — the American Civil Liberties Union, with a focus on battling violence against women, and Children’s Hospital Los Angeles, where she has volunteered for 10 years.

A rep for the ACLU tells PEOPLE that the organization received a $350,000 gift directly from Heard on Aug. 19. According to O’Donnell, the rest of her pledge will be made after the settlement is finalized.

But the exes have been at odds over which of them would give the money to charity.

A rep for Depp previously announced that he would make payments directly to the Children’s Hospital and ACLU on Heard’s behalf. A member of Heard’s team rejected Depp’s payment plan, saying in a statement, “If Johnny wishes to change the settlement agreement, we must insist that he honor the full amount by donating $14M to charity, which, after accounting for his tax deduction, is equal to his $7M payment obligation to Amber.” The rep added that Depp should make the payment in a lump sum rather than in installments.

“Johnny is obligated by the settlement to pay Amber, and she in turn will honor her pledges to Children’s Hospital and the American Civil Liberties Union,” says O’Donnell. “Amber’s commitment to protecting victims of domestic violence and helping sick children is her life’s work.”

O’Donnell also addresses Heard’s recent appearance in a video about domestic violence for the #GirlGaze Project. The actress, who during her divorce claimed that Depp had verbally and physically abused her, fought back tears as she shared her personal story in the video. Heard never mentions Depp by name, and is prohibited from addressing allegations about him under her settlement agreement.

“Her recent PSA on domestic violence does not violate her settlement agreement with Johnny,” says O’Donnell. “She will continue to lend her voice to the rising chorus of women speaking out about this terrible scourge on the American family.”
