It looks like Kesha’s performance at the Billboard Music Awards is back on.
The singer was originally scheduled to perform a cover of Bob Dylan’s “It Ain’t Me, Babe,” but the label she’s signed to, Dr. Luke’s Kemosabe Records, rescinded its written approval for the performance after a report in TMZ indicated she might use the performance to make a statement over her ongoing legal dispute with Dr. Luke.
Kesha has sought to get out of her contract, saying that Dr. Luke sexually abused her when they were working together. Dr. Luke denies wrongdoing, and a judge upheld the contract, denying a preliminary injunction in January.
The singer responded to the cancelation on Instagram on Wednesday, saying the performance “never had anything at all to do with Dr. Luke.” Now, Kemosabe said in a statement, the approval has been reinstated:
Kesha’s performance on the Billboard Music Awards was always approved, in good faith. Approval was only suspended when Kemosabe learned Kesha was to use the performance as a platform to discuss the litigation. Now that Kemosabe has obtained assurances, that it is relying upon, from Kesha, her representatives and Dick Clark Productions that neither Kesha nor her supporters will use the performance as such a platform, the approval has been restored.
Kesha performed “It Ain’t Me, Babe” at the Orpheum Theatre in Los Angeles on Wednesday night, appearing alongside Ben Folds. The Billboard Music Awards take place on Sunday.
